A Qualified Mortgage, or QM, meets defined federal requirements intended to limit certain risky features and support an ability-to-repay determination. Government-insured or guaranteed mortgages and other eligible loans can qualify under applicable QM categories.
A Non-QM loan falls outside those QM definitions. That does not make it unlawful or automatically unsafe, and it does not describe one standard set of features.
Consumer protection still matters
Non-QM does not mean no ability-to-repay review
For covered consumer mortgages, the CFPB's Ability-to-Repay rule generally requires the creditor to make a reasonable, good-faith determination that the consumer can repay the loan according to its terms. Income or , employment when relied on, credit history, debts, expenses, and the mortgage obligation may be part of that review.
QM status provides specified legal protections when its requirements are met. A Non-QM creditor uses another compliant basis for the covered transaction; the category is not permission to ignore repayment ability.

Standard documentation does not fit every legitimate scenario
